Privacy Policy

Maison Berger will treat all its Users’ personal information (the “Personal Information”) as confidential on a secure server and will comply with all applicable privacy and data protection legislation and/or regulations. Maison Berger will only disclose the Personal Information in the circumstances set forth below. Upon registration on the Maison Berger Website, or upon making a purchase, each User will be asked to input, and Maison Berger will collect, personal details such as the User’s name, e-mail address, billing address, telephone number. Maison Berger may also collect, and Maison Berger’s third party providers may collect, information about where Users are on the internet (e.g. the URL Users came from, IP address, domain types such as .com), Users’ browser type, country and telephone area code where Users’ computer is located, the pages of Maison Berger website that were viewed during Users’ visit, any advertisements Users may have clicked on, and any search terms that Users entered on the Maison Berger Website. Maison Berger confirms that any personal details which Users provide to Maison Berger (or which are publicly available) and any User information, from which Maison Berger can identify Users, is held in accordance with all applicable privacy and data protection legislation and/or regulations.

Maison Berger will use Users’ Personal Information only for the following purposes: (i) maintaining Users’ registration, (ii) for statistical purposes to improve the Maison Berger Website and its services to Users, (iii) to serve website content to Users, (iv) to administer the Maison Berger Website and (v) to notify Users of products or special offers.

Maison Berger will not release Users’ Personal Information to any company outside of the Maison Berger Group. If a User wishes to unsubscribe from receiving promotional emails or direct mail from Maison Berger, such User should email support@maisonberger.us and insert “Unsubscribe” as the subject line and include the email address that the User wishes to be unsubscribed from (if it is not the email address that the User sent the email from), User’s full name and address.

Mobile Message Service Terms and Conditions

The Maison Berger USA mobile message service (the "Service") is operated by Maison Berger USA (“Maison Berger USA”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Maison Berger USA SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Maison Berger USA through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Maison Berger USA. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to 1-844-578-8634 in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Maison Berger USA mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Eligibility to Purchase Items / Disqualification

By registering on the Maison Berger Website to purchase Items on a personal and non-professional basis in the participating stores, the Users represent and warrant that (i) the personal information provided upon registration on the Maison Berger Website is true, accurate and current in all respects, (ii) they are natural persons, legally capable of entering into binding contracts and not impersonating any other person or entity, or using a false name, (iii) they are the holder of a valid debit or credit card and (iv) they are at least 18 years old. The Users shall not purchase Items on the Maison Berger Website with an intent to resell them.

Making a Purchase

Users will be guided through the process of placing an order by a series of instructions on the Maison Berger Website. Users may place their order for Items on the Maison Berger Website by clicking on the “Confirm Order” button at the end of the online order process.

Once an order has been placed, Maison Berger will send the User an email acknowledging the exact details of the order, providing the User with a payment reference and the value of the User’s order that will be debited from the User’s debit or credit card (the “Order Acknowledgement”). Such Order Acknowledgement does not constitute an order confirmation or order acceptance from Maison Berger. The User’s debit or credit card shall be charged in United States Dollars (US$) and all applicable taxes and fees (including, but not limited to applicable, excise, state and local taxes), as well as shipping fees, shall be added.

Unless Maison Berger notifies the User that Maison Berger does not accept the User’s order or the User has cancelled his order in accordance with the return policy set forth below, Maison Berger’s acceptance of the User’s order and the completion of the contract between the User and Lampe Berger will occur when the User receives an email from Maison Berger notifying the User that the Items ordered have been dispatched (the “Confirmation Email”). Maison Berger’s acceptance of an order will be deemed complete at the time and date such Confirmation Email is sent to the User, regardless of the User’s actual time and date of receipt of such Confirmation Email. Any information regarding an order can be requested by emailing Maison Berger’s Customer Service at support@maisonberger.us . Emails are generally answered within 24 hours.

Maison Berger reserves its right not to accept an order if (i) an Item if out of stock, (ii) Maison Berger is unable to obtain authorization to validate the User’s payment method or (iii) Maison Berger identifies an Item or pricing error. Although Maison Berger endeavors to keep the Maison Berger Website as up to date as reasonably possible, Maison Berger but cannot guarantee that any particular Item will always be available. If Maison Berger cannot supply any Item, Maison Berger will release the funds being held in the User’s account for the purchase.

In the event Maison Berger is unable to fulfill an order following its Order Acknowledgement, the User will be contacted by email or telephone. Maison Berger will try to keep its Website as up to date as reasonably possible but cannot guarantee that any particular Item will always be available. If Maison Berger cannot supply an Item, Maison Berger will release the funds being held in the User’s account for the purchase.

As Maison Berger Items purchased through the Maison Berger Website may be delivered to addresses other than the billing address given by the debit or credit card holder, for example in case of a gift being purchased and addressed to another person, as a security precaution, an e-mail and a copy of the invoice will be sent to the debit or credit card billing address.
